Dear Visitor!

We would like to inform you that the Office of the Parliamentary Commissioner – comprising the Office of the Parliamentary Commissioner for Civil Rights, the Office of the Parliamentary Commissioner for the National and Ethnic Minorities Rights and the Office of the Parliamentary Commissioner for Future Generations –, according to the Act 111 of 2011 on the Hungarian Commissioner for Fundamental Rights, has ceased to exist. From 1 January 2012 its tasks were overtaken by its legal successor, the Office of the Commissioner for Fundamental Rights.

The WFC held its 5th Annual General Meeting 'The next 5 years. Growing and Acting together' in Hamburg, where members of the Council, Supervisory Board, Board of Advisors and staff discussed and drew up strategies and activities for the coming year. Key topics were the upcoming Earth Summit in Rio in 2012, rights of future generations and the spreading of best policy solutions in climate/energy, sustainable ecosystems, sustainable economies and peace and disarmament. Mr. Sándor Fülöp, the Hungarian Parliamentary Commissioner for Future Generations was invited to participate at the meeting, as an official member of the Council.

Representatives of 70 international, European and national environmental citizens organizations (ECOs) from 30 countries met under the auspices of the European ECO Forum in Astana, the capital of Kazakhstan, on 20-21 September 2011. They gathered to formulate their demands and recommendations in a report called Astana Declaration to the governments at the 7th UN-ECE European Environmental Ministers Conference, “Environment for Europe” (EfE), taking place in Astana, on 21-23 September 2011. On behalf of our office, Mr. János Zlinszky, Head of Strategy and Research Department participated at the Forum.

The draft ombudsperson act of the Hungarian Ministry of Public Administration and Justice violates the Constitution and changes the legal status of the commissioners
The opinion of the Hungarian parliamentary commissioner for future generations about the draft Act on the Commissioner for Fundamental Rights (JNO-427-2/2011)

According to Mr. Sándor Fülöp the draft act wishes to regulate the institution of ombudspersons based on a proposal without thorough grounding, in several respects against the new Constitution, while in other regards seriously ignoring the content of the fundamental law. The draft wants to create an absolutely insignificant deputy institution through narrowing down the commissioner’s competence and sphere of action, and pushing the interests of future generations into the background. The draft seriously violates the new fundamental law, it would implement a constitutionally inacceptable step back, therefore the green ombudsman suggests to repeal and reframe it. Mr. Fülöp has sent his opinion related to the draft on 8 June 2011 to Mr. Tibor Navracsics, the minister of public administration and justice, furthermore to other decision-makers.

The 11th edition of Green Week will take place from 24 to 27 May 2011 in Brussels. This year's theme is "Resource Efficiency - Using less, living better". Last year the conference attracted over 3400 experts from all over the world. There were attendees from government, business and industry, non-governmental organisations, academia and the media. The session “Monitoring our impact on the environment: the role of Ombudsmen” will be held on Wednesday, the 25th of May from 16.30 to 18.00. The Hungarian Commissioner’s presentation will reintroduce the functions of the Ombudsman’s office and will highlight the results, key challenges and problems of the last years.

Conference on the ecological services of the Danube
The Office of the Parliamentary Commissioner for Future Generations organized a conference on the 20th of October, 2010 on the ecological services of the Danube to promote the UN initiative of the International Year of Biodiversity. At the conference the representatives of different professional sectors systematically reviewed the ecosystem-services provided by the river, the goods of wildlife and habitats (clean water, building material, navigation route, place of excursion, flood plain vegetation, food etc.), which are used by humans directly or indirectly in their lifetime and therefore the condition of these goods does determine people’s quality of life. Building on these conference presentations, our office prepared a draft statement on the conservation of ecological services and usufructuary possibilities.

Conference on protection against noise
Based on the lessons of individual cases, our office has launched a comprehensive examination in order to be able to formulate guidelines for the legal practice and legislative proposals for the revision of the regulation. In the framework of the examination we carried out thematic consultations with several environmental inspectorates, the chief inspectorate and the ministry. Our aim was to get to know and to process the good practices developed during the course of public administration procedures and the major problems of legal practice emerged in the procedures of environmental authorities. To discuss the issues of protection against noise in a broad professional circle, we organized a conference on the 6th of October, 2010 with the participation of the authorities, municipalities and professional organizations. We have summarized the result of our comprehensive examination in a draft statement outlining our proposals concerning the reform of the regulation of protection against noise. The draft was circulated in a broad circle for harmonization in order to guarantee to the maximum extent the sound professional foundations of the complex legislative proposal which is to be submitted finally to the government.
